Where — Terms of Service
Effective date: 28 October 2026 · Version 1.0
1. What these terms cover
These terms are the agreement between you and the operator of Where, based in Zagreb, Croatia, for using the Where app. By creating an account you accept them. If you do not, do not use the app.
Our handling of your personal data is described in the Privacy Policy, which forms part of these terms.
Contact us at privacy-where@googlegroups.com.
2. Who may use Where
You need an account, created by signing in with Google or Apple.
You must be at least 18 years old. We ask for your date of birth and our servers refuse an account for anyone younger. If we find that an account belongs to someone under 18 we delete it.
You are responsible for everything done through your account. Do not share it.
3. What Where is — and what it is not
Where shows a map of nearby real-world events, each with a group chat. Events are created by users, not by us.
We do not organise, host, vet, supervise, staff or insure any event. We do not verify that an event is what its description says, that its organiser is who they claim, or that attending is safe or lawful where you are. We are not a party to any arrangement between you and anyone you meet through the app.
Meeting people from the internet in person carries risk that no app removes. You decide whether to attend an event, and you do so at your own risk. Tell someone where you are going. Meet in public where you can.
To the fullest extent the law allows, we are not liable for anything that happens at or because of an event, for the conduct of anyone you meet through Where, or for any loss, injury or damage arising from a meeting arranged through the app. Nothing in this section limits liability that cannot be limited by law — including liability for death or personal injury caused by our negligence, for fraud, or any mandatory right you have as a consumer.
4. Your content, and the licence you give us
What you post stays yours — event descriptions, chat messages, photos, videos, participant notes.
To run the service we need permission to store what you post and show it to the people it is meant for: for a group chat, the other participants; for an event, whoever can see that event. So you grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit and display your content for that purpose and for the moderation described in section 5, and to let the hosting and storage providers named in the Privacy Policy hold it on our behalf. The licence lasts as long as we hold the content and exists for no other purpose: we do not use your content to advertise, and we do not license it onward to anyone else.
The licence outlives your account for content that is part of someone else's conversation. Messages you sent, and files attached to them, stay in those chats with you shown as an anonymised sender, and events you already held remain. The Privacy Policy says exactly what deletion does and does not reach — read it before deleting your account.
5. Zero tolerance for objectionable content
This is a zero-tolerance policy. You may not post, send, upload or organise:
- harassment, bullying, threats, or intimidation of anyone;
- hate speech, or content attacking or demeaning people on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age or serious disease;
- any sexual content involving a minor, or any sexualisation of a minor — see below, this one is treated differently from everything else;
- sexually explicit material, or nudity presented sexually;
- content promoting or instructing self-harm, suicide, or disordered eating;
- violence, threats of violence, incitement, or glorification of either;
- content that is unlawful where the event takes place, or an event arranged in order to commit an offence;
- impersonation of another person or organisation;
- spam, scams, pyramid or referral schemes, or commercial solicitation;
- another person's private information without their consent — including inside a participant-only note, which is private to an event's participants but is still covered by every rule here;
- attempts to identify the exact location of an event whose creator chose to blur it, or to share that location outside the event.
What we do about it
We may, without notice and at our discretion: remove content; cancel an event; remove a participant from an event; suspend an account temporarily; or ban an account permanently.
Reports are triaged automatically. A report classed as serious can be appealed once in the app within 14 days. The Privacy Policy explains how automated moderation works and how to reach a person about it — read that section before appealing, because the in-app appeal is itself automated.
Content involving minors
There is no tolerance of any kind here. Where a report of this kind is founded we remove the content,
ban the account permanently, and report it to the Ministry of the Interior of the Republic of
Croatia and to the Centre for a Safer Internet (csi.hr), Croatia's hotline for this material,
and we preserve what that report needs for as long as the authorities ask us to.
6. How to report and block
- Report a user or an event from the app. You do not need to block someone to report them.
- Block a user from the app. Blocking is mutual and immediate for direct messages: a blocked person cannot send you a direct message and you will not see theirs. It does not currently hide their messages in a group or event chat you both belong to — leave the event, or report them, if that is what you need.
Using these is never a precondition for us acting. We may act on our own initiative.
7. How you must behave
Do not use Where to stalk, follow, surveil or trace anyone. Do not scrape, automate, reverse engineer, or attempt to access data you are not entitled to. Do not interfere with the service's operation or security, or attempt to bypass a ban.
8. Your licence to use the app
We grant you a personal, non-transferable, revocable licence to install and use Where on devices you control, for your own non-commercial use, for as long as these terms are in force. The app itself, its name and its design stay ours. You may not copy, modify, redistribute or sell it, or remove any notice from it.
9. Ending the agreement
You can delete your account at any time from Settings in the app, or by writing to privacy-where@googlegroups.com. What deletion does and does not reach is set out in the Privacy Policy — read it, because messages you have already sent remain in other people's conversations, with you anonymised.
We may suspend or terminate your account for breach of these terms, or where we are required to.
Sections 3, 4 and 12 survive the end of this agreement.
10. Availability and changes to the service
We do not guarantee the service will be available without interruption. We may add, change or remove features. The app shows a maintenance screen when the service is unavailable.
Where is provided free of charge. There are no purchases in the app.
11. Changes to these terms
If we change these terms in a way that matters to you, we will tell you in the app at least 30 days before the new version takes effect, and the new effective date will be shown at the top of this page. If you do not accept the new terms, delete your account before that date; continuing to use Where afterwards means you accept them. The previous version stays available at https://where-app.io/legal/archive.
12. Legal
No warranty. Where is provided as it is. To the extent the law allows, we make no warranty that it will be uninterrupted, error-free, or fit for a particular purpose, and we do not warrant anything about events, users or content created by other people.
Limitation of liability. To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost data, or loss arising from your use of the app or from anyone you meet through it. Where is free of charge and we receive nothing from you, so where liability cannot be excluded it is limited to the amount you have paid us, which is nothing.
Nothing excluded that cannot be. None of this affects liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for a breach of mandatory consumer rights, or anything else the law does not permit us to limit. If you use Where as a consumer, you keep every right the law of your country of residence gives you.
Indemnity. You are responsible for what you post and do through Where, and for any claim brought against us because of it.
Disputes. These terms are governed by the law of Croatia, and disputes go to the courts of Croatia. If you are a consumer resident in the European Union, you may also bring a claim in the courts of your own country, and this clause does not deprive you of the protection of its law.
The rest. If a clause is unenforceable the others still apply. We may transfer this agreement as part of transferring the business; you may not transfer it. These terms, with the Privacy Policy, are the whole agreement between us about Where.
